　　司法部關于統一繼承在加拿大遺產委托書格式的通知

　　各省、自治區、直轄市司法廳(局)：

　　據我駐加拿大使館反映，由于我國公證機關現在出具的用于繼承在加遺產的委托書，不符合加方有關規定，給我國公民繼承在加遺產帶來了困難。為此，經與我駐加使館和外交部領事司研究，現擬定了新的委托書格式，并附英譯文本。今后公證機關辦理繼承在加遺產的委托書公證，均應依此格式書寫。

　　我們是×××(死者)的××和××(稱謂關系)，×××(死者)于××××年×月×日在加拿大死亡，死亡時在加拿大留有遺產，我們作為×××的繼承人〔或根據中華人民共和國××省××市公證處××××年×月×日發給我們的()××字第××號繼承權公證書〕，現委托×××先生(或女士，小姐)為我們的合法代理人，全權代理我們在加拿大辦理繼承上述遺產的一切事宜，為我們領取、管理和處分上述遺產。在代理我們辦理上述事項中，代理人有權出席法庭了解對遺產的估算過程、同意或反對對遺產的估算及方法。代理人有權對財產轉讓證書、擔保證書、公文、憑單、權利放棄和記錄等所有的有關文書簽字、加封和執行，就繼承遺產之事有權以我們的名義實施民事法律行為，代理人為代理上述事項所實施的民事法律行為和簽署的法律文書我們均予以承認。
