　　司法部關(guān)于統(tǒng)一繼承在加拿大遺產(chǎn)委托書格式的通知

　　各省、自治區(qū)、直轄市司法廳(局)：

　　據(jù)我駐加拿大使館反映，由于我國公證機關(guān)現(xiàn)在出具的用于繼承在加遺產(chǎn)的委托書，不符合加方有關(guān)規(guī)定，給我國公民繼承在加遺產(chǎn)帶來了困難。為此，經(jīng)與我駐加使館和外交部領(lǐng)事司研究，現(xiàn)擬定了新的委托書格式，并附英譯文本。今后公證機關(guān)辦理繼承在加遺產(chǎn)的委托書公證，均應(yīng)依此格式書寫。

　　我們是×××(死者)的××和××(稱謂關(guān)系)，×××(死者)于××××年×月×日在加拿大死亡，死亡時在加拿大留有遺產(chǎn)，我們作為×××的繼承人〔或根據(jù)中華人民共和國××省××市公證處××××年×月×日發(fā)給我們的()××字第××號繼承權(quán)公證書〕，現(xiàn)委托×××先生(或女士，小姐)為我們的合法代理人，全權(quán)代理我們在加拿大辦理繼承上述遺產(chǎn)的一切事宜，為我們領(lǐng)取、管理和處分上述遺產(chǎn)。在代理我們辦理上述事項中，代理人有權(quán)出席法庭了解對遺產(chǎn)的估算過程、同意或反對對遺產(chǎn)的估算及方法。代理人有權(quán)對財產(chǎn)轉(zhuǎn)讓證書、擔(dān)保證書、公文、憑單、權(quán)利放棄和記錄等所有的有關(guān)文書簽字、加封和執(zhí)行，就繼承遺產(chǎn)之事有權(quán)以我們的名義實施民事法律行為，代理人為代理上述事項所實施的民事法律行為和簽署的法律文書我們均予以承認(rèn)。
