涉外婚姻的有關(guān)規(guī)定(附英文)
中國公民同外國人辦理婚姻登記的幾項規(guī)定(附英文)
(一九八三年八月十七日國務(wù)院批準(zhǔn))
一、中國公民同外國人(包括常駐我國和臨時來華的外國人、外籍華人、定居我國的僑民)在中國境內(nèi)自愿結(jié)婚的,男女雙方當(dāng)事人必須共同到中國公民一方戶口所在地的省、自治區(qū)、直轄市人民政府指定的婚姻登記機(jī)關(guān)申請登記。
二、申請結(jié)婚登記的男女雙方,必須遵守中華人民共和國婚姻法和本規(guī)定的有關(guān)條款。
三、申請結(jié)婚登記的中國公民和外國人,須分別持有下列證件:
甲、中國公民:
(一)本人的戶籍證明:
(二)本人戶口所在地的縣級人民政府或工作所在單位的縣級以上機(jī)關(guān)、學(xué)校、事業(yè)、企業(yè)單位出具的本人姓名、性別、出生年月、民族、婚姻狀況(未婚、離婚、喪偶、下同)、職業(yè)、工作性質(zhì)、申請與何人結(jié)婚的證明。
乙、外國人:
(一)本人護(hù)照或其他身份、國籍證件;
(二)公安機(jī)關(guān)簽發(fā)的《外國人居留證》,或外事部門頒發(fā)的身份證件,或臨時來華的入境、居留證件;
(三)經(jīng)本國外交部(或外交部授權(quán)機(jī)關(guān))和我駐該國使、領(lǐng)館認(rèn)證的由本國公證機(jī)關(guān)出具的婚姻狀況證明;或該國駐華使、領(lǐng)館出具的婚姻狀況證明。
丙、外國僑民:
(一)本人護(hù)照或代替護(hù)照的身份、國籍證件(無國籍者免交);
(二)公安機(jī)關(guān)簽發(fā)的《外國人居留證》;
(三)本人戶口所在地縣級人民政府或工作所在單位的縣級以上機(jī)關(guān)、學(xué)校、事業(yè)、企業(yè)單位出具的本人姓名、性別、出生年月、婚姻狀況、職業(yè)、申請與何人結(jié)婚的證明。
此外,申請結(jié)婚的男女雙方,還須提交婚姻登記機(jī)關(guān)指定醫(yī)院出具的婚前健康檢查證明。
四、下列中國公民不準(zhǔn)同外國人結(jié)婚:
(一)現(xiàn)役軍人、外交人員、公安人員、機(jī)要人員和其他掌握重大機(jī)密的人員;
(二)正在接受勞動教養(yǎng)和服刑的人。
五、凡證件齊全、符合本規(guī)定的中國公民和外國人,可持證件和男女雙方照片,到婚姻登記機(jī)關(guān)提出申請。經(jīng)婚姻登記機(jī)關(guān)審查了解,符合中華人民共和國婚姻法和本規(guī)定的準(zhǔn)予登記,一個月內(nèi)辦理登記手續(xù),發(fā)給結(jié)婚證。結(jié)婚證須貼有男女雙方當(dāng)事人照片,并加蓋辦理涉外婚姻登記的縣級以上人民政府婚姻登記專用章(鋼印)。
六、中國公民和外國人在華要求離婚的,應(yīng)按中華人民共和國《民事訴訟法(試行)》有關(guān)規(guī)定,向該管人民法院提出離婚訴訟。要求復(fù)婚的,按結(jié)婚辦理。
七、申請結(jié)婚的中國公民和外國人應(yīng)向婚姻登記機(jī)關(guān)交納婚姻證書工本費和登記手續(xù)費。所需翻譯費由本人自理。
八、本規(guī)定經(jīng)國務(wù)院批準(zhǔn)后施行,過去有關(guān)規(guī)定同時廢止。

PROVISIONS FOR THE REGISTRATION OF MARRIAGE BETWEEN CHINESE
CITIZENS AND FOREIGNERS
(Approved by the State Council on August 17, 1983 and promulgated
by the Ministry of Civil Affairs on August 26, 1983)
1. When Chinese citizens and foreigners (including foreign residents and
those who come to China for a short visit, Chinese of foreign nationality,
and foreigners who have settled down in China) decide to get married of
their own free will within the boundaries of China, both the man and the
woman concerned shall appear together at the marriage registration
department, designated by the province, autonomous region, or municipality
directly under the Central Government, and stationed in the locality where
the Chinese citizen has his/her residence registration and apply for
marriage registration.
2. Both the man and the woman, who apply for marriage registration, shall
abide by the Marriage Law of the People s Republic of China and the
pertinent articles and items of these Provisions.
3. Chinese citizens and foreigners who apply for marriage registration
shall respectively hold the following certificates:
A. For Chinese citizens:
(1) certificates of the applicant s residence registration;
(2) certificate signed and issued either by the people s government at the
county level or above which is stationed in the locality where the
applicant has his/her residence registration, or by a government
department, a school, an institution, or an enterprise at the county level
or above, which is the applicant s place of work; the certificate
indicates the applicant s name, sex, date of birth, nationality, marital
status (single, divorced, bereft of spouse - the same below), occupation,
nature of work, name of the person to marry.
B. For foreigners:
(1) the applicant s passport or other documents certifying his/her
identity and citizenship;
(2) \"Residence Permit for Foreigners\" signed and issued by the public
security department, or identification certificate issued by foreign
affairs department, or entry permit and residence permit for foreigners
who come to China for a short stay;
(3) marital status certification issued by the notary office of the
